Appellate law is one of our many service areas. We are routinely asked to file appeals in state and federal courts for our clients. The justice system is one where all too often a mistake can lead to the wrong party being castigated, forced to pay money they did not owe, or worse, lose their freedom. Appeals courts are the failsafe measure to the justice system where people who have received a judgment against them can return to court and have their case reviewed by a new set of eyes. Each case is different and in order for appeals to be filed there must be a legal ground or cause for appeal. This is where our firm comes in.
Miller, Miller & Menthe has helped individuals and businesses file appeals and restore their rights and reputation.
The appeals process is not a new trial. That would potentially come after successful appeals, although in most cases the prosecutor or the opposing attorney will refrain from returning to court. An appeal is instead a “trial of the trial” so to speak, where the judge reviews the case for any violations of the individual’s rights or where there was misconduct involved. This is why appeals are usually performed by specialists because it is an altogether different approach to a case.
Firms such as ours who handle appeals have specialists who spend long hours reviewing the case for any and all points of legal entry for briefs to be submitted. This is a very detail-oriented process and the appeals attorney should have enough knowledge to understand exactly what to look for and exploit in the brief. When we take on appeals for anyone we know that this is a “do or die” situation and that we are the last stand against our client either going to jail or paying a large settlement that he or she may not deserve.
Miller, Miller & Menthe have years of appeals experience behind us that we can rely on when reviewing your case for its potential. We want to ensure that anything we file to the court is something that can be successful appeals. When you come to us with your case you will have the full benefit of our team’s knowledge and experience.
